Article 1 - Definitions
The terms used in these Standard Parking Terms and Conditions have the meanings set out below, unless otherwise agreed in writing. Terms in the singular include the plural and vice versa, where the text so requires. References to one gender include all genders.
1.1 | Subscription: A parking Subscription that confers the right to use the Parking Facility during an agreed period and on agreed terms at a specific monthly, quarterly or annually tariff. |
1.2 | Subscription Holder: The holder of a Subscription that confers the right to use the Parking Facility during an agreed period and on agreed terms. |
1.3 | Car Park User: a natural or legal person who brings a Vehicle into the Parking Facility and the occupant(s) of the Vehicle, including Subscription Holders. |
1.4 | Parking Facility: RAI’s parking garage and/or outside car park, together with access roads and accessible areas, located at Europaplein 24 Amsterdam, the Netherlands, including in any event the P1 to P4, and P7 car parks. |
1.5 | Parking Ticket: The form of proof of payment chosen by the Car Park User and designated by RAI – including a car park ticket, credit card or car park pass – that entitles the Car Park User to gain entry to the Parking Facility and on the basis of which RAI can determine the time of entry and exit from the Parking Facility. |
1.6 | Parking Fee: The amount owed by the Car Park User for the use of the Parking Facility. For Subscription Holders, the Parking Fee consists of the agreed charge for the Subscription and (if applicable) a charge for any parked hours not covered by the Subscription. |
1.7 | Parking Space: The parking space for an individual Vehicle to be used by the Car Park User in the Parking Facility. |
1.8 | Parking Terms and Conditions: These Standard Parking Terms and Conditions, as drawn up by RAI. |
1.9 | P+R: Part of the Parking Facility, namely the P1, P2 and P4 car parks, where the Car Park User can park at a reduced P+R rate, subject to the specified terms and conditions, provided he continues his journey by public transport. |
1.10 | RAI: RAI Amsterdam B.V., which has its registered office at Europaplein 24, Amsterdam (commercial register no. 92449174). |
1.11 | Vehicle: All motorised vehicles such as private cars, commercial vehicles and motorcycles, with a maximum length of 4.80 metres, a maximum width of 1.90 metres, a maximum weight of 2,800 kg and a maximum height as displayed at the entrance to the Parking Facility. |
1.12 | Access Refusal Days: Days on which RAI may refuse Subscription Holders access to the Parking Facility, as described in article 10 below. |
Article 2 - Applicability
2.1 | Access to the Parking Facility is granted only subject to these Parking Terms and Conditions, which immediately constitute part of either the parking agreement concluded between the Car Park User and RAI on a one-off basis or the parking agreement for Subscription Holders. |
2.2 | Where no use is made of a Subscription, a parking agreement between the Car Park User and RAI is deemed to have been concluded merely by virtue of the use of the Parking Facility. In the event of a disagreement about whether or not the Parking Facility is being or has been used, the determining factor will be whether the Car Park User has been recorded by the RAI parking system as having driven into the Parking Facility. |
Article 3 - Obligations of RAI
3.1 | RAI will make a random space for a single Vehicle available to the Car Park User in the Parking Facility, subject to availability. If the Parking Facility is full, this is at the risk of the Car Park User. |
3.2 | The Parking Facility complies with the statutory requirements and is intended to be used for parking Vehicles. |
3.3 | RAI will endeavour to ensure that its website provides information about days on which the Parking Facility is closed or can only be used by visitors to an event in the RAI Convention Centre. No rights may ever be derived from this by the Car Park User. |
Article 4 - Access requirements
4.1 | The Car Park User may use the Parking Facility only with a valid Parking Ticket. The Parking Facility may not be used for purposes other than the parking of Vehicles. |
4.2 | Vehicles may enter the Parking Facility only during the opening hours displayed in or at the Parking Facility. The normal opening hours are from 06.00 to 00.00 seven days a week, unless indicated otherwise. RAI reserves the right to change the opening hours from time to time. Vehicles may exit the Parking Facility at any time of the day or night, seven days a week. |
4.3 | Only those Vehicles indicated at the entrance to the Parking Facility are entitled to gain entry to it. |
4.4 | No trailers of any kind may be towed into the Parking Facility. |
4.5 | The Vehicles parked in or at the Parking Facility must meet the same conditions as Vehicles parked on the public highway. |
4.6 | RAI is at all times entitled to refuse any Vehicle entry to the Parking Facility if it deems this desirable. This may occur, for example, if RAI considers that the Vehicle may cause damage or endanger safety because of its size or weight or the materials/substances it is carrying. |
4.7 | If RAI considers it necessary, its staff are entitled to move Vehicles and/or persons within the Parking Facility and/or to remove them or cause them to be removed from the Parking Facility, without RAI incurring any liability as a result. |
Article 5 - Use of parking facility
5.1 | The Car Park User enters and uses the Parking Facility entirely at his own risk. The Car Park User must at all times exercise due caution and vigilance, in particular with regard to the height limit of the Parking Facility. | |
5.2 | The Car Park User is obliged to follow the instructions of RAI and, at its request, persons designated by it, including the signage and mandatory driving direction. | |
5.3 | A maximum speed of 5 kilometres per hour (i.e. walking pace) applies in and at the Parking Facility. | |
5.4 | While present in or at the Parking Facility, the Car Park User must behave in accordance with the statutory rules and the Vehicle must meet the statutory requirements. The relevant legislation includes in any case the Road Traffic Act, the Traffic Rules and Signs Regulations, the relevant appendices and the provisions of these Parking Terms and Conditions. | |
5.5 | The Car Park User must park the Vehicle in the designated Parking Spaces and behave in such a way that traffic in and/or near the Parking Facility is not obstructed and safety is not endangered. | |
5.6 | Any Vehicle parked in the Parking Facility must be locked and its lights and engine turned off, and the occupants must leave the Vehicle and the Parking Facility. | |
5.7 | Prohibited activities: | |
a) | using the Parking Facility for purposes other than the parking of Vehicles; | |
b) | offering, selling, renting or distributing goods or services in, at or near the Parking Facility; | |
c) | advertising in, at or near the Parking Facility; | |
d) | smoking or starting a fire in the Parking Facility; | |
e) | carrying harmful, explosive, combustible and/or highly flammable substances and materials in the Vehicle or having them present in the Parking Facility; | |
f) | remaining in the Vehicle for longer than necessary; | |
g) | carrying out repairs (or causing them to be carried out) to the Vehicle or other work in or at the Parking Facility; | |
h) | leaving rubbish in, at or near the Parking Facility, other than small items deposited in the rubbish bins intended for that purpose; | |
i) | the use by pedestrians of the ramps, entrances and exits intended for Vehicles; | |
j) | the use of the ramps, entrances and exits by non-motorised Vehicles, including bicycles, scooters, skates or skateboards. | |
5.8 | The Parking Facility has several charging points for electric vehicles. For the use of a charging point, the Car Park User is obliged to pay additional costs per kWh consumed, in accordance with the rates displayed at the charging points and ticket machines. Parking Spaces with an electric charging point may be used only by electric vehicles. | |
5.9 | The maximum continuous parking period for a Car Park User who is not a Subscription Holder is 30 days. | |
5.10 | The Parking Facility has several Parking Spaces for disabled persons. A Parking Space for disabled persons may be used only if the Vehicle has a disability badge visibly displayed. |
Article 6 - Parking fee
6.1 | This article does not apply to Subscription Holders. |
6.2 | A Parking Fee is payable by the Car Park User for the use of the Parking Facility. The Parking Fee is calculated on the basis of the applicable parking tariffs as displayed on the RAI website and the tariff boards located at the entrance to the Parking Facility. The parking tariffs have a daily maximum. Payment of the daily tariff only entitles the Car Park User to enter and exit the Parking Facility once. |
6.3 | The amount of the Parking Fee depends on the length of time the Vehicle is parked, i.e. the period between the times it enters and exits the Parking Facility as recorded by means of automatic number plate recognition. |
6.4 | For the use of electric vehicle charging points, the Car Park User is obliged to pay the additional costs as referred to in article 5.8 of these Parking Terms and Conditions. |
6.5 | The Parking Facility is fitted with a parking system that opens and closes the gate barriers automatically. The Parking Fee can be paid by means of automatic number plate recognition which allows the gate barrier to open automatically when the Vehicle exits the Parking Facility, without the Car Park User receiving an exit ticket. The Car Park User can also buy an exit ticket at the ticket machines, and then scan it at the gate barriers when exiting the Parking Facility. |
6.6 | The Parking Fee must be paid before the Car Park User exits the Parking Facility with the Vehicle. |
6.7 | Under no circumstances may the Car Park User exit the Parking Facility with the Vehicle without prior payment of the Parking Fee. |
6.8 | After paying the Parking Fee, the Car Park User must exit the Parking Facility with the Vehicle as quickly as possible. |
6.9 | RAI reserves the right to adjust the applicable parking tariffs periodically or on a one-off basis. Different parking tariffs may apply, for example for particular events. The parking tariffs displayed at or in the Parking Facility are the applicable tariffs at all times. |
Article 7 - Liability
7.1 | RAI is under no obligation to provide surveillance of the Vehicle. RAI is not liable for theft and loss of the Vehicle or other property of the Car Park User while located in the Parking Facility. |
7.2 | RAI is not liable for damage to the Vehicle or to the property of the Car Park User, or for physical injury and/or any other damage, directly or indirectly caused by or as a result of the use of the Parking Facility, unless the damage has been caused by an intentional or deliberately reckless act or omission on the part of RAI. |
7.3 | RAI is not obliged to pay compensation for damage if it a consequence of fire and/or smoke or weather conditions such as torrential rain, hail, sleet, snow or sun, or if it has been caused by other users of the Parking Facility. |
7.4 | The Car Park User is liable for all damage he causes in the Parking Facility, including damage caused to the Parking Facility or its equipment and systems. |
Article 8 - Reserved parking
8.1 | RAI provides a reservation service, which allows one or more spaces to be reserved in advance in the Parking Facility by using the RAI’s website at a reduced daily tariff as stated on the website. By making a reservation, the Car Park User is assured of being able to park in the Parking Facility. |
8.2 | By making a reservation, the Car Park User is merely assured of the availability of a space in the Parking Facility but is not allocated a specific Parking Space. The Car Park User is free to use any of the available designated Parking Spaces for this purpose. |
8.3 | Parking Spaces with an electric vehicle charging point cannot be reserved. |
8.4 | The Car Park User may reserve a place in the Parking Facility on the basis of either a vehicle registration number or a barcode. If the vehicle registration number changes after the reservation has been made, the Car Park User is requested to contact RAI before using the Parking Facility. |
8.5 | RAI reserves the right to designate a number of Access Refusal Days each year on which use of the Parking Facility and hence also reservation of a space in the Parking Facility is not possible. If an Access Refusal Day falls within a planned parking period, the Car Park User will receive notification about this from RAI. |
8.6 | The Car Park User is obliged to pay the relevant Parking Fee when making the reservation, prior to the entire parking period. If the Car Park User wishes to cancel his reservation completely, any payments he has made will be refunded. In the event of a partial cancellation of the reservation, the Car Park User is entitled to a refund of only that part of the payments that relates to the reduced period of the reservation. |
8.7 | If the Car Park User has made use of the Parking Facility for longer than envisaged and provided for in the reservation confirmation, he will owe RAI an additional amount equal to the standard parking tariff for each hour or each day that the use of the Parking Facility lasts. |
Article 9 - Park & Ride (P+R)
9.1 | The Parking Facility enables the Car Park User to use the P1, P2 and P4 car parks at a reduced P+R tariff provided he continues his journey by public transport (tram, train, bus or metro) on the conditions set by the municipality of Amsterdam. If the Parking Facility is full, this is at the risk of the Car Park User. |
9.2 | The daily fee for the use of P+R applies either on working days when the Car Park User enters the Parking Facility after 10.00 hrs or during weekends and public holidays for a maximum of 24 hours. The higher daily fee for the use of P+R on working days applies when the Car Park User enters the Parking Facility before 10.00 hrs for a maximum of 24 hours. The applicable daily fees are displayed on the RAI website. |
9.3 | If the Car Park User uses the Parking Facility for more than 24 hours, he will owe the standard parking tariff for the number of hours or days referred to in article 6 of these Parking Terms and Conditions. |
9.4 | RAI reserves the right to close the P+R in the Parking Facility, in which case parking at the P+R rate will not be possible. The days on which the P+R is closed are shown on the RAI website or by means of signage at or near the Parking Facility. |
9.5 | The Car Park User is only eligible for the reduced P+R tariff if he meets the relevant conditions, for example those set by the Municipality of Amsterdam and Amsterdam Municipal Transport Company (GVB). These conditions can be found at the Municipality of Amsterdam’s website. RAI is not responsible for the content of this website, and it follows that if the information it contains is incorrect or incomplete this cannot be invoked by the Car Park User against RAI. |
Article 10 - Subscriptions
10.1 | This article applies exclusively to Subscription Holders. |
10.2 | RAI provides two types of Subscription: one for local residents and the other for corporate customers. The terms and conditions for corporate Subscriptions are recorded in a parking facility agreement concluded between RAI and the Subscription Holder. |
10.3 | Any local resident who can show that he possesses a Vehicle and lives in the vicinity of the Parking Facility is eligible for a Subscription. A Subscription for a local resident can start on each day of the relevant month. |
10.4 | A local resident Subscription is valid for three months and can be renewed thereafter. The tariffs for local resident Subscriptions can be found on the RAI website. |
10.5 | Different tariffs apply to corporate Subscriptions, as agreed in the relevant parking facility agreement. |
10.6 | A Subscription entitles the holder only to park in a vacant space in the Parking Facility and not to the use of a specific Parking Space. The sole entitlement of the Subscription Holder is to use any of the vacant Parking Spaces designated for this purpose in the P1 to P4 car parks. RAI does not guarantee the availability of vacant parking space in the Parking Facility. |
10.7 | Subscription Holders are not permitted to use the electric vehicle charging points in the Parking Facility, unless agreed otherwise. If a Subscription Holder does use an electric vehicle charging point to charge the Vehicle, RAI reserves the right to move or tow away the Vehicle. |
10.8 | A Subscription is issued on the basis of the registration number of one Vehicle, with entry to and exit from the Parking Facility being regulated by automatic number plate recognition. If the registration number of the Vehicle changes, the Subscription Holder should notify RAI. |
10.9 | If the Parking Facility is used after the Subscription expires, or on days on which the Subscription is not (or is no longer) valid, the Subscription Holder will owe the standard hourly or daily tariff for the number of hours or days that the Parking Facility is used. |
10.10 | RAI reserves the right to change the Subscription fees annually. Subscription Holders will be notified of this at their stated email address. |
10.11 | Changes to a Subscription that are necessary as a result of government decisions or official instructions (including instructions issued by the fire service) do not entitle the Subscription Holder to obtain a refund of the Subscription fees or to cancel the Subscription. |
10.12 | RAI reserves the right to refuse to allow Subscription Holders to use the Subscription on a maximum of twenty days a year (Access Refusal Days). This means that a Subscription Holder who nonetheless parks in the Parking Facility on an Access Refusal Day will owe the applicable parking tariff. |
10.13 | Subscription Holders will not be entitled to any compensation for Subscription Fees paid by them in the event of Access Refusal Days. Access Refusal Days will be communicated by RAI to Subscription Holders at least two months beforehand by message to their stated email address. |
10.14 | A Subscription is intended solely as a right to use the Parking Facility to park Vehicles intended for daily use. The Subscription Holder is therefore not permitted to use the Parking Facility for other purposes, for example for garaging a Vehicle. RAI will regularly check the use made of the Parking Facility by monitoring the vehicle registration number. RAI reserves the right to cancel a Subscription if it is found that the Subscription Holder is making improper use of the Parking Facility. |
Article 11 - Personal data
Personal data of the Car Park User are processed by RAI and any third-party processors in accordance with the General Data Protection Regulation (GDPR). More information can be found in our Privacy Statement under Events.
Article 12 - Complaints
Complaints about the use of the Parking Facility should be communicated to the management of RAI either by registered letter at the address of RAI or by means of the contact form on the website, preferably immediately and in any event within two (2) months after the parking has taken place. Complaints submitted after this period will no longer be considered by RAI.
Article 13 - General provisions
13.1 | These Standard Parking Terms and Conditions are governed by Dutch law. |
13.2 | Any disputes that arise from the parking agreement between the Car Park User and RAI must be brought exclusively before the competent court in Amsterdam, the Netherlands. |
13.3 | If and in so far as any provision of these Standard Parking Terms and Conditions is void or voidable, the other provisions will remain fully in force. RAI will then adopt a new provision to replace the void/voidable provision, which will take account of tenor of the void/voidable provision as far as possible. |
13.4 | RAI reserves the right to alter the Standard Parking Terms and Conditions. Once the Standard Parking Terms and Conditions enter into force, they will replace all previous terms and conditions, unless expressly indicated otherwise by RAI. |
